1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of the website, services, and communications provided by MKP Enterprise LLC ("MKP," "we," "our," or "us"). By engaging our services, submitting an inquiry, or purchasing any service through this website, you agree to be bound by these Terms.

2. Services Provided

MKP Enterprise LLC provides strategic consulting, operational advisory, eco-smart workplace solutions, executive coaching, and management consulting services ("Services"). Each Service is described on our website with its associated scope and fee. Specific deliverables, timelines, and engagement details for a given Service will be confirmed directly with the client prior to or at the start of the engagement.

3. Fees and Payment

- All fees for Services are listed on our website and are due at the time of purchase unless otherwise agreed in writing.

- Fees are quoted in U.S. Dollars (USD).

- Payment is processed through our third-party payment processor(s). MKP does not store full payment card details.

- Additional services outside the original agreed scope may incur additional fees, to be agreed upon in advance.

4. Cancellation and Refund Policy

- Consultation and coaching sessions (e.g., Executive Coaching) may be rescheduled or canceled with at least 48 hours' notice for a full refund or credit toward a future session. Cancellations made with less than 48 hours' notice are non-refundable.

- Larger engagements (e.g., Management Consulting, Green Workplace Consulting) are billed based on scope and project phase. Refunds for these engagements are evaluated on a case-by-case basis and are generally available only for work not yet performed, prorated based on completed milestones.

- No refunds will be issued for Services that have been fully delivered or completed.

5. Client Responsibilities

Clients agree to provide accurate, complete, and timely information necessary for MKP to perform the Services. Delays or inaccuracies in information provided by the client may affect project timelines and are not the responsibility of MKP.

6. Intellectual Property

All content on this website, including text, graphics, logos, and materials created as part of a Service engagement, remains the intellectual property of MKP Enterprise LLC unless otherwise agreed in a signed engagement agreement. Clients may not reproduce, distribute, or resell MKP's proprietary materials without prior written consent.

7. Confidentiality

MKP will treat client information shared during an engagement as confidential and will not disclose it to third parties except as required to deliver the Services, comply with the law, or as otherwise described in our Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by law, MKP Enterprise LLC's total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total fees paid by the client for the specific Service giving rise to the claim. MKP shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption, arising from the use of our Services.

9. No Guarantee of Results

While MKP applies professional expertise and industry best practices in delivering Services, we do not guarantee specific business outcomes, financial results, or performance improvements, as these depend on factors outside our control, including client implementation and market conditions.

10. Termination

MKP reserves the right to terminate or suspend access to Services at our discretion, including in cases of non-payment, misuse, or violation of these Terms. Clients may terminate an ongoing engagement in accordance with the cancellation terms outlined in Section 4.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Miami-Dade County, Florida.

12. Changes to These Terms

MKP may update these Terms from time to time. Continued use of our website or Services after changes are posted constitutes acceptance of the revised Terms.
